Promotion between Applegreen & Nestle

The Parties agree that these terms and conditions (the “Terms and Conditions”) prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the Terms and Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

The Promoter takes data protection seriously. By entering in this promotion, participants confirm that they have read the Privacy Policy, and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the promotion, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR), the Data Protection Act 2018 and Applegreen’s Privacy Policy which can be accessed here: https://applegreenstores.com/wp-content/uploads/2020/02/App-Privacy-Policy.pdf

THE PROMOTION:

1. The promotion is open to legal residents of Ireland (excluding Northern Ireland), excluding employees (and their immediate families) of the Promoter, affiliated companies, agents, or anyone else professionally connected with the promotion.
2. Entrants must be aged 18 years or over.
3. No purchase is necessary.
4. Entrants must have access to the internet.
5. A valid Facebook or Instagram account and access to the internet are required. Entrants who do not have a Facebook or Instagram account, will need to create one in order to participate. Please see www.facebook.com or www.instagram.com for more details. All entries will be subject to the Terms of Service for Facebook or Instagram which are available online at www.facebook.com or www.instagram.com
6. The entrant entering the promotion must be the owner of the Facebook or Instagram account used.
7. Any entries received from private Facebook or Instagram accounts will not be entered due to privacy restrictions.Participants who are holders of a private Facebook or Instagram account must amend their account settings to a public account in order for their entry to be accepted. The account must remain public during the promotion and for fourteen (14) days after the end of the promotion to enable the Promoter to contact the entrant in the event of their entry being a winner.
8. Maximum 1 entry per person during the promotional period.
9. Failure on the part of an entrant to comply with any part of these Terms and Conditions will disqualify the respective entry from the promotion.

   Promotional Period

10. The prize draw entry period opens at 17:00 on
    13.09.23 and closes at 17:00 on 19.09.23.
11. Any entries received outside of these times
    and dates or deemed not to be of suitable standard in accordance with the
    requirements of clause 15 below, will not be included in the prize draw and
    will not have a chance to win a prize.

    To Enter

12. Instagram: Entrants must: (1) FOLLOW the @_applegreen__ Instagram page; (2) LIKE the promotional post; and (3) COMMENT on the promotional post telling us your favourite KitKat flavour to enjoy on a break with a cuppa.

    OR

13. Facebook: Entrants must: (1) LIKE the Applegreen Facebook page; (2) LIKE the promotional post; and (3) COMMENT on the promotional post telling us your favourite KitKat flavour to enjoy on a break with a cuppa.
    
14. Bulk entries made from trade, consumer
    groups, aliases or third parties will not be accepted. Incomplete or illegible
    entries, entries by macros or other automated means (including systems which
    can be programmed to enter), and entries which do not satisfy the requirements
    of these Terms and Conditions in full will be disqualified and will not be
    counted. If it becomes apparent that an entrant is using a computer(s) to
    circumvent this condition by, for example, the use of ‘script’, ‘brute force’,
    masking their identity by manipulating IP addresses, using identities other
    than their own or any other automated means in order to increase that entrant’s
    entries into the promotion in a way that is not consistent with the spirit of
    the promotion, that entrant’s entries will be disqualified and any prize award
    will be void.
15. Moderation: By participating, entrants understand and agree to their comments for this promotion being publicly displayed. Such entries may be attributed to the original entrant using their name as provided with their entry or as shown on their account. Entries will be strictly monitored by the Promoter. The Promoter and their agents reserve the right to reject any entries for any reason in their sole discretion and the Promoter will reject entries which, in the reasonable opinion of the Promoter:
    1. Contains any content that is offensive or could reflect negatively on the name, reputation, or goodwill of the Promoter or any brand partner;
    2. Includes trademarks, logos, or copyrighted material not owned by the entrant or used without the right holder's prior written permission (including famous names, company names, etc.);
    3. Defames, misrepresents, or contains content for the intended purpose of harassing, threatening or embarrassing individuals or multiple individuals or insults other people or companies, including, but not limited to the Promoter (including its partners);
    4. Promotes any political, blasphemous or religious agenda or any image deemed to incite religious hatred;
    5. Is deemed to be distasteful, degrading or will in any way cause offence:
    6. Contains images of third parties who have not expressly consented to feature in promotion;
    7. Contains any images of children;
    8. Is a duplicate entry;
    9. Any Instagram or Facebook name or profile photograph which contravenes the above will be void, and any entries will not count; and
    10. Any entry that contains any computer viruses, worms, Trojan horses or other potentially damaging computer programs or files.
16. Comments should not imply, mention or tag another person except where the entrant has obtained express permission to publicly share their image or platform name. All entries must conform to Instagram or Facebook guidelines and terms and conditions.
17. The Promoter and their agents reserve the right, but not the obligation, to monitor and review the content submitted, and to remove or refuse to take forward as an entry any content submitted that the Promoter does not deem, in its sole discretion, to be appropriate, or which the Promoter deems to violate any of these Terms and Conditions.
18. All entries will be strictly monitored by the Promoter and their third-party adjudicators throughout and any attempts to manipulate or otherwise unfairly influence the prize draw will result in disqualification of entry or suspension of the promotion.
19. The Promoter reserves the right to report any content violations to the appropriate authorities.
20. The Promoter does not guarantee that you will have any recourse to edit or delete any content you have submitted. You acknowledge that you, not the Promoter, are responsible for the contents of your submission. None of the content that you submit shall be subject to any obligation of confidence on the part of the Promoter, its agents, subsidiaries, affiliates, or third-party service providers and their respective directors, officers and employees. The person who uploaded the comment is the individual who is entered into the prize draw and the entrant confirms that s/he has obtained any and all releases and consents (if relevant) of third parties necessary to permit the submission for the purposes of this prize draw in the manner set forth in these Terms and Conditions without additional compensation.

    The Prize

21. There is one (1) prize available to be won in total. The prize consists of 1 x €750 voucher for a Hotel of the winner’s choice.
22. In the event that the prize listed at clause 21 above is not available or cannot be awarded due to unforeseen circumstances, the Promoter reserves the right to substitute the prize for an alternative prize of equal or greater value.
23. Prizes are not transferable or exchangeable unless otherwise stated.
24. Please allow up to twenty-eight (28) days for delivery of the prize from the date of winner acceptance.
25. The Promoter cannot be held responsible for any third-party products or services.
26. There will be one (1) winner selected at random from all eligible entries received via a post/comment on the official Applegreen Facebook and Instagram pages (details of which are contained in clauses 12 and 13 above) by the closing date (5pm on 19.09.23). The winner will be selected at random but the selection shall be checked to ensure the correct criteria are met.

    Winner Selection & Notification/Fulfilment:

27. The
    winner will be contacted by an agent of the Promotor via a message under their
    original entry on Instagram or Facebook within three (3) standard working days
    of the closing date providing them with instructions to direct message the
    Promoter. Thereafter, the winner will be contacted by an agent of the Promoter and
    will be required to respond to confirm eligibility and provide address
    information for the fulfilment of their prize.
28. Inaccurate
    information provided by the winner may result in the prize being forfeited. In
    the event any winner does not respond to communications within the three (3)
    days of initial contact, or is disqualified after verification checks, the
    Promoter reserves the right to forfeit and withhold the prize from this
    potential winner and allocate that prize to an alternative winner selected next
    in line as a reserve at the same time as when the original was selected.
29. On
    completion of the validation process, the prize will be sent to the winner by
    special delivery, post or courier, via a tracked and signed for service, within
    twenty-eight (28) days of confirmation of the winner’s address.

    General

30. Anyone
    who, in the Promoter’s absolute discretion, is acting in a manner that
    undermines the operation and integrity of the promotion or in any way which
    gives an unfair advantage will be disqualified and any persons seeking to use
    such information gained will be disqualified. The Promoter reserves the right to verify all
    entries including but not limited to asking for address and identity details
    (which they must provide within fourteen (14) calendar days.
31. 31. Limitations of liability: insofar as permitted by law, the Promoter does not assume any responsibility for:
    1. Any
       faulty, incorrect, failed or erroneous electronic data transmissions.
    2. Communications
       line failure, regardless of cause, with regards to any equipment, systems,
       networks, lines, satellites, servers, computer or provider utilised in any
       aspect of this promotion.
    3. Entries
       lost, damaged or delayed. Proof of sending will not be accepted as proof of
       receipt.
    4. Inaccessibility
       or unavailability of the internet, or any website/social media site, or any
       combination thereof.
32. All
    normal internet connection charges associated with the submission of an entry
    to the promotion shall be the entrant’s responsibility.
33. If
    for any reason the promotion is not capable of running as planned for reasons
    including but not limited to tampering, unauthorised intervention, fraud,
    technical failures or any other causes beyond the control of the Promoter which
    corrupt or affect the administration, security, fairness, integrity or proper
    conduct of this promotion, the Promoter reserves the right (subject to any
    written directions given under applicable law) to disqualify any individual who
    tampers with the entry process and to cancel, terminate, modify or suspend the
    promotion or invalidate any affected entries but will endeavour to minimize the
    effect to entrants in order to avoid undue disappointment.
34. By
    entering the promotion, the entrant agrees that the Promoter may contact them
    to ask whether they want to participate in publicity relating to the promotion.
35. The Promoter and its associated agencies
    and companies will not be liable for any loss (including, without limitation,
    indirect, special or consequential loss or loss of profits), expense or damage
    which is suffered or sustained (whether or not arising from any person’s
    negligence) in connection with this promotion or accepting or using the prize,
    except for any liability which cannot be excluded by law (including personal
    injury, death and fraud) in which case that liability is limited to the minimum
    allowable by law.
36. This
    promotion is in no way sponsored, endorsed or administered by, or associated
    with Instagram or Facebook. The entrant accepts and understands that they are
    providing their information to the Promoter, and that Instagram or Facebook has
    no liability for any element of this promotion. Furthermore, any
    questions, comments or complaints regarding the promotion will be directed to
    the Promoter only.
37. By
    entering this promotion, all participants will be deemed to have accepted and
    be bound by these Terms and Conditions. Subject to the Promoter’s Privacy
    Policy, the winner’s surname and county of residence will be made available on
    request 25.09.2023 for
    a minimum of three (3) months, by sending a self-addressed envelope to : “win a
    hotel break*” to: Applegreen, Petrogas Group Limited, Block 17, Joyce
    Way, Park West Business Park, D12F2V3. When contacting this email
    address, the entrant’s request will be actioned in line with Applegreen’s
    Privacy Policy. The Promoter
    reserves the right to refuse any or all such requests. If any winner
    objects to their information being published, then they can contact the
    Promoter by emailing
    dpo@applegreen.ie. We may nevertheless
    disclose the information to the Advertising Standards Authority if required to
    do so.

38. The Promoter shall have
    sole and final determination as to which entries are genuine and therefore
    eligible to take part in this promotion. The Promoter’s decision is final and
    binding.
39. Any
    person posting, or seen to be posting, comments to the Promoter’s social media
    pages or elsewhere during the promotion that are considered bullying, spiteful
    or upsetting to other
    participants, fans of the Promoter or directly aimed at the Promoter, will have
    their comments removed and will be disqualified from the promotion.
40. If any provisions of these Terms &
    Conditions are judged to be invalid, illegal or otherwise unenforceable, then
    its shall be severed and deleted from these Terms and Conditions and the
    remaining clauses shall survive and remain in full force and effect.
41. The Promotion and these Terms &
    Conditions will be governed by the laws of Ireland but any disputes as to the
    meaning of these Terms and Conditions will be subject to the exclusive
    jurisdiction of the courts of Ireland.
42. Data Protection: The Promoter will only use the personal details supplied for the
    administration of the promotion and the auditing of the entries where necessary
    and for no other purpose, unless we have your consent/you have opted-in to
    receive future marketing communications. The surnames and counties of the
    verified winners will be made available as set out in the appropriate clause
    above and the winner can object to this by emailing: dpo@applegreen.ie. Otherwise, your personal details will at all times be kept
    confidential and will be processed in accordance with the General Data
    Protection Regulation (GDPR), the Data Protection Act 2018 and the Promotor’s

    your personal data, have any inaccuracies rectified or request deletion of
    personal data by sending an email to dpo@applegreen.ie. By participating in the promotion, you agree to the use of your
    personal data as described in these Terms and Conditions. You can withdraw your
    consent at any time by sending an email to dpo@applegreen.ie. For the purpose of the promotion, requests to delete personal
    data can only be actioned after the promotion has concluded.
